For about a Year I have been Talking about Really Bad stuff Going on Here, stuff that makes your blood boil and brings ya to your knees at the shock of it, and most do not believe a word I say. Yet those same folks that are living in the land of denial are emailing me, calling me to ask about the Local Eureka Police Drama.... they seem to be clueless as to what is really going on and in that will believe whatever the Tobacco Valley News, the Secretary running the town, the commissioner and the Big Names playing the Big Games of the Tobacco Valley TELL them to believe or what they put out as the Official Story... Look Deeper Folks, wake up.. the Truth - True Justice - the Rule of Law - Obeying the Law by those who are suppose to enforce it. .. there is alot more to EVERYTHING then you are being fed.

I am saddened and shocked at the amount of people over the last year who have stood up for what I am doing and trying to say, not very many. r From starting this news by the people for the people blog network, I have seen very few people speak up and tell the truth. And I have heard the sickest stories imagineable. I understand just wanting to live in your little bubble and not create waves. I get it. Especially in areas Famous for Supposed Suicides that end up really being murders but are never investigated because a county sheriff is the law of the land, these stories are statewide.
People touch on the truth, but seriously We, You cannot handle the Truth. It is to disturbing at every level and the corruption, secrets, and denial is at the top levels and you the people pay for their wages to do this to you, and you keep your head down for fear of your life and your families life. So much I now wish I did not know. So many have come to me with the sickest and the saddest of stories.. and truly there is nothing no one is willing to or can do.

MOST of my Blog visitors are statewide and nationwide but not FROM Eureka... r Since starting my News Blogs I have heard of corruption accusations at the highest levels, I have heard first hand stories of people beaten by Lincoln County Cops, heard of children raped and beaten in their homes by family and not heard, I have heard of Horrible crimes to innocent animals, I have heard of human trafficking stories and date raping druggings where by groups of woman are drugged and raped and photos are taken, video is taken and if the girls remember any of it well they are discredited immediately by video, by the town mouths flapping about them having a drink or they should not have been there… when the TRUTH is GHB - the Date Rape drug can be in water.

The commissioners say the rapes are drug and alcohol related and that is the common denominator. I say that the Common denominator is the Lack of Crimes EVER being punished in Eureka Montana - in Lincoln County. And with Marianne Roose flat out lying to the Public how does the real victims get any justice, she herself is attacking such a victim in court... There is no Justice anywhere in Sight in Lincoln County Montana.

I have heard stories of the same Drug runners working your streets for decades and even driving local school buses - no one cares.... many call me and ask why is there such a high rate of miscarriage and disease at the local schools with kids and workers .. I have no answer. r
People call with such Hope that I can help them.. and I cannot.. as they tell me of calling the cops for help and the cops beating them and then jailing them.. THEY CALLED FOR HELP.

Stories of young girls corned by Libby Cops to trade sexual favors for NO TICKET.. or to not get in trouble when caught drinking. r
Stories of Drug informants - Dealers doing sick stuff to their daughter for years on end and social services ignoring it.. protecting them.

Stories of Mothers losing all parental Rights by Montana Judges... for NO proven lawful reason. r Rumors of "It cost $50,000 for a Montana Supreme Court Decision", and Corruption so deep and so wide that you will never get justice of any kind. So what Next.. Give Up ?

Some of the Stories I have heard over the Last Year have rattled me, some of the photos I have seen have sickened me, and at this point I am not sure what to say to people, I hate to say Give up and go Cry in a Dark room.. NO ONE IS LISTENING.. so I keep yapping to give them hope.. but the truth is.. I have come to feel that there is NO HOPE for these folks. h The City cops in Eureka Montana and the County Law enforcement have very bad relationships and local arrests MEAN nothing, for the folks in Libby let them back out on the street as soon as they feel the public won’t cause to much rucus about it. h no True Justice is Given in Our County.... Look at the Arrests, look at the paperwork, the plea bargains, the deals, the "suicides".. just take a look at it all and you will know that there is so much more to ALL the stories you have been FED for decades by local controlled media. R I am told this is happening in other states and certainly all over Montana so it is nothing NEW.

“Nearly all” of the amicus brief filed last week by the Northwest Montana Association of Realtors (NMAR) is irrelevant to the issues involved in the city of Whitefish’s lawsuit against the county over the so-called “doughnut” area, city attorney John Phelps claims in his Feb. 6 response to the Realtors.Furthermore, NMAR’s brief contains information about the city’s Critical Areas Ordinance (CAO) that is “incorrect, exaggerated or untrue,” Phelps said.
The city has asked Flathead County District Court Judge Katherine Curtis to enter a preliminary injunction stopping the county from taking any further planning or zoning action in the “doughnut,” and to make it effective from May 1, 2008.
NMAR wants the preliminary injunction to be effective beginning Dec. 23, the date when the Montana Supreme Court overturned Curtis and ordered her to enter a preliminary injunction.The impact of the CAO on property owners within the two-mile planning and zoning jurisdiction was the focus of NMAR’s amicus brief, but Phelps says the city’s lawsuit is a contract dispute over the interlocal agreement between the city and the county that created the “doughnut” area.“Although the CAO was the reason for Flathead County’s attempt to rescind the interlocal agreement, the CAO is not at issue in this case,” Phelps said.
To support his point, Phelps cited the findings of fact adopted by Curtis on May 1, 2008, which said that “the validity of the CAO is not at issue in this action, and the views of the Flathead County Commissioners concerning the ordinance is irrelevant to this court’s determination of whether or not (the city) is entitled to the preliminary injunction it seeks.”Phelps also countered NMAR’s claim that the “more than 5,000” property owners in the “doughnut” are indispensable to the case.“Under our system of government, local government units can enter into interlocal agreements without approval of voters or property owners,” Phelps said.
Phelps also pointed out that the city had warned the court that if the preliminary injunction was denied, planning and zoning actions subsequently approved by the county “might be wasted” if the district court’s ruling was reversed.“But for the national slow-down in real estate development, the situation would be far worse,” Phelps said.
As for the two “doughnut” area lakeshore permits issued by the county last year, Phelps said the city was willing to validate them even if Curtis restores the status quo back to May 1 last year.
Accompanying Phelps’ response was the affidavit of Whitefish attorney and former Montana Supreme Court justice Terry Trieweiler, who has consulted with the city in the “doughnut” lawsuit.Trieweiler said he investigated NMAR’s claim that the arguments in the amicus brief represent the interests of its 855 members
I Really Must State My Opinion on Terry Trieweiler. I thought he was awesome, I researched him and thought that he was in the best interest of the Real Estate Consumer. I had a real estate client who contacted Terry Trieweiler because of his Supreme Court experience and his apparent interest in the Real Estate Consumer. He had them in tears within the hour. He is Cruel, in my opinion, he is unfeeling. He does not care about the Real Estate Consumer and makes the Real Estate Victim feel like the Criminal even when obvious, blatant and proven fraud cases are brought to him. Terry Trieweiler on NMAR's side, seemingly, is a direct attack against the real estate consumer. Possibly on the Side of the Developer, the Realtor and Big Money and assuradly NOT on the Side of the Montana Real Estate Consumer.
For the third time in less than a year, documents have been filed by people who want a say in the city of Whitefish’s lawsuit against Flathead County over the two-mile planning and zoning jurisdiction commonly called the “doughnut” area.
Flathead County Commissioner Jim Dupont and “doughnut” resident Anne Reno filed for intervenor status on Feb. 18.
Two separate parties filed for intervenor status in March 2008 — Heiko and Elizabeth Arndt, who own property on Whitefish Stage Road, and Westridge Investments LLC, with principal R. Matthew Moran, which owns property on Birch Glen Road.
Then in January this year, the Northwest Montana Association of Realtors filed an amicus brief in support of the county.In his application, Dupont cites the importance of the “doughnut” issue in last year’s county commissioner election.
Dupont notes that his Republican primary opponent, incumbent commissioner Gary Hall, admitted the interlocal agreement that created the “doughnut” was a mistake.Dupont also notes that his Democratic opponent, Steve Qunell, favored Whitefish control over the planning and zoning area, and only one of the three current county commissioners, Joe Brenneman, supports the interlocal agreement.“Dupont believes that previous commissioners should not be able to bind future commissioners on legislative issues, such as enacting zoning and growth policies in the doughnut,” his application states. Reno, who owns property on Eagle Creek Trail, “is a single mother living on limited means,” the application states, and “her home is her major asset and nest egg for retirement.”

BUTTE – Mosquito control efforts could be extended next summer into south Butte and as far west as Ramsey.
Dan Powers of the Butte-Silver Bow Health Department says residents in areas being considered to become part of the mosquito control district will be sent letters to find out whether they support the plan.
MILLTOWN – Montana Gov. Brian Schweitzer became one of the first people in more than 120 years to legally float past the confluence of the Clark Fork and Blackfoot rivers in a symbolic gesture to showcase work that is returning the river to its natural state.
The governor brought along a fly rod on Friday and landed an 18-inch cutthroat trout in a part of the river once blocked by the Milltown Dam.

HAVRE – The Hill County Sheriff's Office has arrested three Havre-area men in connection with a fire that destroyed the Havre Jaycees fireworks booth on Tuesday.
The Havre Fire Department determined the fire was suspicious. The investigation was then turned over to the Hill County Sheriff's Office.
On Thursday, the sheriff's office conducted searches of two separate Havre area homes, which resulted in the recovery of a large amount of fireworks.

I frequently pull up Sold information on Residential listings in Whitefish for clients who are watching our Real Estate market trends. The results from May 1, 2009 to today are amazing. We truly have something for everyone, older original Whitefish houses right in town are going for $170,000 - with houses on the lake going for $2 million. You can still live here, wait tables, be a teacher, a nurse, or teach skiing and afford to buy a house. What other ski resort town can offer that? Having grown up in California on the beach, and knowing that to buy a house I would be so far inland that I might as well move out of the state (which I obviously did) it is refreshing to know it isn't that way here yet. I believe that this range of residential offerings is what gives us our great diverse community. You can drive a Subaru or an Escalade and we all live in the same place. The official opening day of Summer at Whitefish Mountain Resort is June 27th, 2009. We have some great new activities on our mountain, we have a Brand New Alpine Slide, 4 Zip Lines and improved biking trails including the still new 'Runaway Train'. (Trails opening subject to conditions and snow.) Check out Whitefish Mountain Resort website for up to the minute updates. The Danny On is still snow covered, but the ride down is cheap! Hike up and ride down free. The Danny On is one of the first hikes I did when I moved here and one that I still love. Ten minutes from my door to the trail head is a plus but the hike is so many other things as well. Serene and beautiful with mind blowing views and 2000 vertical to kick a booty into shape. Our Summers are fast, fabulous and furious so get here quick, or you may miss it!
You can still see the snow up on Whitefish Mountain Resort but you know Spring has arrived, because the Farmers Market 2009 season begins tonight, Tuesday, May 26th. All Market vendors offer locally grown or made produce, plants, foods, art, and crafts. It's a perfect, sunny, spring evening for live music and local produce. Nate will be in the Truby's wood fired pizza trailer making those tasty pies, Becky and Todd will be serving up crepes in the red Amazing Crepes bus so make a night of it. The Tuesday Farmers Market is located in downtown Whitefish, at the intersection of Central and Railway in front of the O'Shaugnessy Theatre. The market runs from 5 - 7:30, May through September. Well, you may have noticed, I completely blew past April here on my blog. It was a busy month. Daylight savings has commenced, days are getting longer and warmer, daffodils are popping up all over town, trees are starting to bud out and the lake has no more ice on it. There is still snow on the mountain and several folks are still hiking up for some solo runs but my skiis are put away and my flip flops are out.
A lot happened in April, downtown we had an art gallery close and in its place, three business owners set up shop. My friends who own Amazing Crepes have their crepe burners in the window and you can get a fresh crepe, and a great espresso coffee while you browse through Station 8 antiques or have a treatment at Remedies Day Spa. It is a great use of space, something that makes sense in our new world economy, three great businesses sharing a unique space. Also, for quite sometime now, Truby's Wood Fired Pizza has been hovering over the valley and looking for a place to land. Kristin has taken the restaurant to Meadowlake Resort in Columbia Falls. She has met both her loyal and new customers in the middle, between Whitefish and Columbia Falls. The restaurant just completed its first week of business and it has been so great to have her back in operation. If you are visiting Glacier National Park and making your way back to Whitefish it is right on your way, if you are looking for somewhere to go for a great dinner or a friendly bar to have a drink, Truby's is there for you. The setting is wonderful, fantastic outside seating right on the golf course and the inside is cozy with new dark wood booths, welcoming paint colors and Karen Minton has several of her paintings on display. The food, as always is phenomonal, some great new entrees and of course, the pizza. In this location there wasn't quite enough room for the wood fired oven so she is using brick oven pizza decks and many have said that they almost prefer the way the pizza cooks in them. She is open 7 days a week for lunch and dinner - Truby's Fine Food & Spirits at Meadowlake Resort, go to the Resort's website and you can check out the Dinner and Wine Menus. May is a great month here in Whitefish, our Farmer's Markets begin this first week of May on Tuesdays and Thursdays, Whitefish Gallery Nights or often referred to as "Art Walk", the first Thursday of each month begins - lots to do. I spoke with some friends and they were in Glacier yesterday, some paddle boarding on Lake McDonald and others for a bike ride.
Montana, the last best place, any time of the year.
Well, for those of us who ski, you could consider it one heck of a stimulus package. Eight inches of new snow over night, snow all day and more snow forecasted all week. Today was the last day that Hell Roaring Basin was open for the season and they were just opening it as I got off of Chair One. My sister and I skied down to Grey's Golf course and it was knee deep untracked powder. Awesome. You could hear whooping and hollering all the way down the run from the others that had made it there at the same time.
It is so fun to live in a small ski town, especially on days like these, silly grins on peoples faces and hearing the word 'epic' used in a lot of sentences. I even had a very strong urge to call someone 'dude', but refrained.
Yes, the recession is making it a tough time for most, but what it can't do is take away the amazing natural amenities we have here in Montana and today was just a reminder of how the simple things are most often times the best. A great run, on a great hill, with great friends. Stimulus Package indeed.
Sunday, April 5Th is closing day for our Winter Season here at Whitefish Mountain Resort. If you have never skied closing day before it is a great day. Lots of folks ski in crazy costumes and then for the last chair of the year a lot of people wait at the Summit House for that final chair of the year, signified by the orange traffic cone sitting all alone on the chair lift. A big cheer goes up and we all ski down with thoughts of rafting, fishing, biking and playing in the sun starting to fill our heads. It has been a great winter season and the Resort has lots in store for this summer, new zip lines, alpine slide and more bike trails.
A few weeks ago I went to The Lodge at Whitefish Lake for Chappy's Trivia Night. The Lodge at Whitefish Lake is a beautiful place to stay, dine or have a drink with friends. There is outdoor seating in the summer on the covered deck above the pool, and indoors is cozy with a great bar and several fireplaces. As the name implies, The Lodge sits right on the banks of Whitefish Lake and the sunsets that can be viewed from the deck are not to be missed.
Chappy is an infamous local who has been serving drinks and racking up the most vertical on Big Mountain since, well, for a long time. (I am pretty sure that a chocolate martini is one of his famous drinks, but ask him next time you are there.) For years, Chappy would have the most vertical feet racked onto his ski pass. When they scan your pass in the lift line it tracks it for you and you can check how much vert you have racked up on the Whitefish Mountain Resort website. Make no mistake, some folks take this number VERY seriously.
Trivia nights are Thursday's at 7pm, and there are food and drink specials as well as prizes. It was really well organized and although my team came in 4th place, we had a great time. I will never forget one of the questions we were asked, "Auguste Escoffier", the famous frenchman, is associated with what profession?" For some random reason, as trivia is, I knew the answer. Do you?

Check out the new Powder Magazine, February 2009 issue, page 66. There is a one page feature in the 'Stash' section on our beloved Big Mountain at Whitefish MountainResort. If you are a powder skier the picture is worth 1000 words, it was taken inbounds on 'Whiteys' during a 462 inch season snowfall. I would love to be able to ski powder like this, but to be totally honest, I am a 'groomer' girl, lots of turns on a blue run with a little fresh on top make for a happy day for me. We have the best of both worlds, killer deep pow inbounds and fun, fast groomers with lots of rollers as well as our terrain park where you can try your hand at a rail or a box or just a gigantic kicker.

I don't want for much, but what I do want is more gear in my gear closet. When you live in an area like Whitefish, Montana, there is so much to do out your backdoor that if you live here long enough, you 'need' more gear to do it all with. Okay, all you really need is a pair of shoes to get outside, but I have a list and it keeps growing. I would like some skate skis, a pair of K2 twin tips, some snow shoes, a road bike, a better mountain bike, more biking clothes, another pair of gloves (because I lose a pair a season), a new camel back, a new day pack, the list is long. It's a good thing I found out about SteepandCheap.com this irreverent, funny, killer deal, website offers amazing gear at great deals, all day long. They have two rules, 3 items per household and no resale. I don't count calories or sheep, nor do I any longer count the days until my birthday. I have a hard time remembering all my different pin codes, my own phone number (since I don't call myself) and I never weigh myself. The only numbers I keep close track of are my blood pressure and my cholesterol. I know my HDL, my LDL's, my diastolic and my systolic pressure. Because I want to live a long and healthy life, these are really the only important numbers to me, well besides the temp outside, the number of overnight snow fall, but I digress. February 14 and 15th, 'Cabin Fever Days' in Martin City.
Are you out of ideas of what to do with your Valentine this weekend? Are you starting to panic because you haven't planned anything special? Well, panic no more, I have the perfect solution for you, it involves a hysterical annual event combining skis and bar stools. The Martin City Bar Stool Races of course. This year, Kristin Voisin of Truby's Wood Fired Pizza will be there with her mobile trailer, spinning those famous pies, made to order with all your favorite fresh ingredients.
Hungry Horse, Coram and Martin City are three tiny communities located just outside Glacier National Park. The main street through town is blocked off and racers compete against each other for bragging rights that will earn free beers at the local saloons long into next summer. More importantly, this is how the Canyon communities have some crazy fun and do a bit of fundraising. Some proceeds, as usual, go to the Canyon Quick Response Unit, a local emergency response outfit that has saved many lives in this highway corridor so far removed from the rest of the Flathead. Some cash goes to the Martin City Fire Department and still more goes to the local Head Start preschool program. Does this Valentine's Day find you without a Valentine? Stop by Truby's for a pizza, and tell them or sing for them a rhyme and they will give you a Valentine, a cookie that is, they are not giving away the staff. This weekend is truly an event to be experienced. Dressing up... is highly discouraged. Saturday race starts around 11:00 a.m., Sunday race starts a bit later.
My nephews grew up on this hill we call home, Big Mountain. They were skiing before they could walk (they were in backpacks with their Dad on a snowboard) ripping down the hill yelling, "Faster Daddy, faster!" They learned to ski on Chair 6 with ropes around their waists and 'edgie wedgies' on the tips of their skis. The second sentence they may have formed was, "No rope on me Mommy!" yearning for their independence on the hill.
Whitefish Mountain Resort has amazing year round programs for kids. My nephews grew up competing in the Tommy Moe Kids League and are now on the Whitefish Mountain Resort Freestyle Team. Living in a place like Whitefish, Montana is amazing for children. They grow up active, which boosts their self confidence and they spend a lot of time outside. I have seen shy children start with the Tommy Moe Kids League, learn how to wear a racing jersey, charge through giant slalom race gates, stand on a podium to get a medal and high five their friends. Seeing these kids grow up through these organizations has been very rewarding. The grins on their faces is priceless.
My nephew, Parkin Costain (9 years old), took 2nd place last weekend at the Fernie Resort in British Columbia, in the 2009 Snickers Junior Freeskiing competition. Check out the youtube video of the competition. If your kids grow up here, there is a very good chance... they will totally shred.
Are you a dog owner? Do you feel bad seeing the sad face of your pooch as you head out the door for a cross country ski adventure without him/her? Well, be sad no more. One of the great advantages of the Stillwater Mountain Lodge is that it has 'Dog Friendly' Nordic ski trails. Pack up your skiis, and your pooch and go get some exercise together.
Well, I have searched high and low for a good description of an Inversion Weather pattern on google to no avail. Looking at the photo posted here by Brendan Rohan, owner of Stumptown Photo should give you a pretty good idea. I first experienced this weather pattern several years ago before I became a resident of Whitefish and was in town visiting my family over Christmas. It was one of the most beautiful, magical experiences I can remember. Depending on the pressure of the system the cloud settles at different heights on the mountain. As you ride up Chair 1, you are literally in the midst of the cloud. As you continue to ascend the blue sky begins to emerge and it feels like what I imagine entering heaven to be like. Then whamo, blue cloudless sky surrounds you and town is now hidden under the cloud. When Chair 5 is open you can do laps all day in the sun. We had over a week of this strong inversion pattern and I just couldn't stay down in town. I would leave the office saying, "I am going up to the sun." The density of the cloud made it feel like you had entered a special, magical, secret world. Pure bliss.
If you were here in Whitefish this past week you may have noticed we were having an incredible weather pattern up on the Big Mountain. We experienced two things, a very strong 'inversion' weather pattern which in turn created 'Fata Morgana'. It was completely amazing. I have posted some pictures below and will do another post on the 'inversion' phenomena. It was like skiing in April, the sun was out, the sky was crystal blue and the temps were up near 40 degrees. We had almost an entire week of it and now we are back to a more typical January weather pattern with 2 inches of fresh snow this morning.
Fata Morganain short, is an optical illusion, a mirage. It occurs from an atmospheric temperature inversion when warmer air rests above cooler air closer to the ground. Fata Morgana is a very complex mirage showing inverted and upright images with alternations of compressed and stretched regions. During calmer conditions, the stable interface between these air masses can act like a refracting lens. When light passes from one transparent medium to another, in this case two different masses of air, it changes speed and bends. If you have ever put a straw in a glass of water you've likely noticed this before; the straw seems disconnected from itself above and below the water surface. If you prefer skiing with less of an incline, no lift lines or even lifts at all, you should think about an afternoon, or evening of cross country skiing at the Glacier Nordic Center located at the Whitefish Golf Course. The 12.5 km course is professionally groomed and maintained by the Outback Ski Shack. The Outback Ski Shack offer lessons, either private or group, expert advice, quality equipment, for rental or purchase, as well as waxing and repairs. There is a drop box for one time usage of $8 for the course or you can buy a pass for the season. Individual passes are $45 or family passes are $90. Group lessons are $29, Classic skiing daily at 1 p.m. and Skate Skiing lessons on Wednesday, Saturday and Sunday at 10 a.m. Try before you buy! they offer a wide variety of skis to demo. Owner Laura Nugent is very knowledgeable in all forms of cross country skiing and can answer questions and give great advice when buying equipment.

Poor little blog of mine! Only one post for December! When you live where I live, the holidays are just too busy, fun filled, and snow packed, so my blog went on the back burner. My New Year's resolution is at least one new blog post a week, so stay tuned. December in Montana was packed with cross country skiing, caroling parties, down hill skiing, my nephew's freestyle contests and 7 feet of snow on the mountain since Xmas Eve! We have so much snow in town it is amazing. We were hit with a series of storms that just dumped it upon us so if you ever wondered what it was like to live in a beautiful snow globe...now is the time to visit Whitefish, Montana!

The annual Christmas stroll in December always seems to signify the beginning of the holiday festivities here in Whitefish with music, sleigh rides and pictures with Santa. Don't miss this years stroll on Friday, December 5th, downtown Whitefish, 6 - 9 p.m. Central Avenue is blocked off to vehicles and allows only pedestrian traffic. The smell of roasting chestnuts fills the air and vendors along Central Avenue stay open until 9 p.m. Pictures with Santa can be taken at The Backdoor General Store. The decorations are up and there was a light snow in town so it is looking pretty festive here! I hear sleighbells, or was that cowbells...?
Well, it's Monday, the 24Th of November and Thanksgiving is quickly approaching for us Americans. A day to give thanks, think back on our forefathers, spend some quality time with friends and family and eat lots of turkey. I will be giving thanks this year for my family, friends, my health and that I live in such an amazing place. It is 19 degrees (F) and sunny right now in Whitefish, we have a 6 inch base on the mountain and these photos were just taken from the web cams off of the Whitefish Mountain Resort website. (You can also access the web cams from my blog on the top right hand side of the front page.) The web cams are a great tool to use to check out our local ski conditions. Because of where our town sits, the local geography, precipitation, etc... we often experience 'inversion' weather patterns. It will appear foggy with low visibility in town but on those days especially, make sure to check the web cams because it might just be a blue-bird day up on the Summit. If you have never experienced an inversion weather pattern, they can be pretty amazing. When you are on the Summit it is like you are on an island. Looking down towards town all you will see if the top of a cloud. Have a great Thanksgiving, give thanks and as always, pray for snow.

Mountain Biking Around Lake Koocanusa Northwest Montana

It is difficult to find a level section on this ride...you'll continually find yourself going either up or down and around another bend as the road hugs high above the lake's shore. The hills and the distance earn this ride an Experienced rating.

Without a Car you notice alot more and don't spook the critters.
The different smells along the way are wonderful,
pine trees, cottonwood, and all kinds of plant life.

MOST of my Blog visitors are statewide and nationwide but not FROM Eureka... r Since starting my News Blogs I have heard of corruption accusations at the highest levels, I have heard first hand stories of people beaten by Lincoln County Cops, heard of children raped and beaten in their homes by family and not heard, I have heard of Horrible crimes to innocent animals, I have heard of human trafficking stories and date raping druggings where by groups of woman are drugged and raped and photos are taken, video is taken and if the girls remember any of it well they are discredited immediately by video, by the town mouths flapping about them having a drink or they should not have been there… when the TRUTH is GHB - the Date Rape drug can be in water.

The commissioners say the rapes are drug and alcohol related and that is the common denominator. I say that the Common denominator is the Lack of Crimes EVER being punished in Eureka Montana - in Lincoln County. And with Marianne Roose flat out lying to the Public how does the real victims get any justice, she herself is attacking such a victim in court... There is no Justice anywhere in Sight in Lincoln County Montana.

I have heard stories of the same Drug runners working your streets for decades and even driving local school buses - no one cares.... many call me and ask why is there such a high rate of miscarriage and disease at the local schools with kids and workers .. I have no answer. r

Some of the Stories I have heard over the Last Year have rattled me, some of the photos I have seen have sickened me, and at this point I am not sure what to say to people, I hate to say Give up and go Cry in a Dark room.. NO ONE IS LISTENING.. so I keep yapping to give them hope.. but the truth is.. I have come to feel that there is NO HOPE for these folks. h The City cops in Eureka Montana and the County Law enforcement have very bad relationships and local arrests MEAN nothing, for the folks in Libby let them back out on the street as soon as they feel the public won’t cause to much rucus about it. h no True Justice is Given in Our County.... Look at the Arrests, look at the paperwork, the plea bargains, the deals, the "suicides".. just take a look at it all and you will know that there is so much more to ALL the stories you have been FED for decades by local controlled media. R I am told this is happening in other states and certainly all over Montana so it is nothing NEW.

“Nearly all” of the amicus brief filed last week by the Northwest Montana Association of Realtors (NMAR) is irrelevant to the issues involved in the city of Whitefish’s lawsuit against the county over the so-called “doughnut” area, city attorney John Phelps claims in his Feb. 6 response to the Realtors.Furthermore, NMAR’s brief contains information about the city’s Critical Areas Ordinance (CAO) that is “incorrect, exaggerated or untrue,” Phelps said.
The city has asked Flathead County District Court Judge Katherine Curtis to enter a preliminary injunction stopping the county from taking any further planning or zoning action in the “doughnut,” and to make it effective from May 1, 2008.
NMAR wants the preliminary injunction to be effective beginning Dec. 23, the date when the Montana Supreme Court overturned Curtis and ordered her to enter a preliminary injunction.The impact of the CAO on property owners within the two-mile planning and zoning jurisdiction was the focus of NMAR’s amicus brief, but Phelps says the city’s lawsuit is a contract dispute over the interlocal agreement between the city and the county that created the “doughnut” area.“Although the CAO was the reason for Flathead County’s attempt to rescind the interlocal agreement, the CAO is not at issue in this case,” Phelps said.
To support his point, Phelps cited the findings of fact adopted by Curtis on May 1, 2008, which said that “the validity of the CAO is not at issue in this action, and the views of the Flathead County Commissioners concerning the ordinance is irrelevant to this court’s determination of whether or not (the city) is entitled to the preliminary injunction it seeks.”Phelps also countered NMAR’s claim that the “more than 5,000” property owners in the “doughnut” are indispensable to the case.“Under our system of government, local government units can enter into interlocal agreements without approval of voters or property owners,” Phelps said.
Phelps also pointed out that the city had warned the court that if the preliminary injunction was denied, planning and zoning actions subsequently approved by the county “might be wasted” if the district court’s ruling was reversed.“But for the national slow-down in real estate development, the situation would be far worse,” Phelps said.
As for the two “doughnut” area lakeshore permits issued by the county last year, Phelps said the city was willing to validate them even if Curtis restores the status quo back to May 1 last year.
Accompanying Phelps’ response was the affidavit of Whitefish attorney and former Montana Supreme Court justice Terry Trieweiler, who has consulted with the city in the “doughnut” lawsuit.Trieweiler said he investigated NMAR’s claim that the arguments in the amicus brief represent the interests of its 855 members
I Really Must State My Opinion on Terry Trieweiler. I thought he was awesome, I researched him and thought that he was in the best interest of the Real Estate Consumer. I had a real estate client who contacted Terry Trieweiler because of his Supreme Court experience and his apparent interest in the Real Estate Consumer. He had them in tears within the hour. He is Cruel, in my opinion, he is unfeeling. He does not care about the Real Estate Consumer and makes the Real Estate Victim feel like the Criminal even when obvious, blatant and proven fraud cases are brought to him. Terry Trieweiler on NMAR's side, seemingly, is a direct attack against the real estate consumer. Possibly on the Side of the Developer, the Realtor and Big Money and assuradly NOT on the Side of the Montana Real Estate Consumer.
For the third time in less than a year, documents have been filed by people who want a say in the city of Whitefish’s lawsuit against Flathead County over the two-mile planning and zoning jurisdiction commonly called the “doughnut” area.
Flathead County Commissioner Jim Dupont and “doughnut” resident Anne Reno filed for intervenor status on Feb. 18.
Two separate parties filed for intervenor status in March 2008 — Heiko and Elizabeth Arndt, who own property on Whitefish Stage Road, and Westridge Investments LLC, with principal R. Matthew Moran, which owns property on Birch Glen Road.
Then in January this year, the Northwest Montana Association of Realtors filed an amicus brief in support of the county.In his application, Dupont cites the importance of the “doughnut” issue in last year’s county commissioner election.
Dupont notes that his Republican primary opponent, incumbent commissioner Gary Hall, admitted the interlocal agreement that created the “doughnut” was a mistake.Dupont also notes that his Democratic opponent, Steve Qunell, favored Whitefish control over the planning and zoning area, and only one of the three current county commissioners, Joe Brenneman, supports the interlocal agreement.“Dupont believes that previous commissioners should not be able to bind future commissioners on legislative issues, such as enacting zoning and growth policies in the doughnut,” his application states. Reno, who owns property on Eagle Creek Trail, “is a single mother living on limited means,” the application states, and “her home is her major asset and nest egg for retirement.”

NAR claims that Realtors are of a Higher Standard and that the Realtors are working, seemingly relentless at that in which is the best interest of the Real Estate Consumer. However, in the Real World of Real Estate this is Hardly the Case. Realtors Work for Realtors and well, the Real Estate Consumer gets to Shut up and sign on the dotted line.
NMAR, the local Realtors Association is Self Governed, they run over consumer rights in order to get what they want. They throw around their “political weight” because they can and no government or private agency is strong enough to STOP them. What the Realtors Want the Realtors Get.
You can bet that what the REALTORS want the Flathead County Planning Board to do is Good for the Realtors and is NOT good for the Real Estate Consumers. Nobody seems to be able to stop the Realtors from Relentlessly making noise on whatever local development issue their is of the day - week - year... they push and push .. they Sue.. they Stomp and they Eventually get their way.
“Special Government Affairs Committees” the Realtors on this committee hurt the real estate consumer just as many other Realtor. NMAR does not listen to complaints of Realtors that hurt the real estate consumer, they just plug their ears and leave it up to the attorneys to battle at. Ethics is Certainly NOT top on their agenda.
They Use to tell us that all of us being in the Same room violated Anti-Trust laws.. but hey what the Department of Justice don't know...
I once called a local Managing Broker in the Whitefish Real Estate Market, with a Serious issue about an agent they were supervising, I stated the Ethics, the MLS Policies and the laws that were broken and the managing Broker said that she could not hear my complaint because she was on the Grievance Committee at NMAR.. talk about your conflicts of interest. Funny to Me that NMAR is causing such a stir to Get their Way, and that the Forces that Be cannot seem to Stop them. The Consumer Pays their wages yet their daily agenda seems to be to actively pursue that in which hurts the real estate consumer.
If NMAR now has a PAID employee going to planning and local government meetings then this is certainly one more thing to be alarmed about. The Realtors are gearing up for a Fight, and their real fight is to keep their jobs. If the Realtors and the Developers band together - the Realtors get to sell what the Developers build and the Consumers well they just get to Pay the Bill.
They take a portion of the Real Estate Consumer’s money and they use this money to Lobby agains the consumer and to Hire Designated Snitches and to make a whole lot of NOISE to STOMP on Your Consumers Rights.
What happens at the “government meetings” - at Local Planning Meetings is supposed to be state and local officials deciding what is best for their community, which is what they were “Elected” to do. Yet the REALTORS, with all their might and Billions of Dollars behind them get their way over what is best for you. And though you pay for your Politicians to act on your behalf, the Realtors come in and knock everybody over and take over the show. Which if you ever by and sell real estate is something your paying for as well.
Typically local commissioners – planners and those who hold government office do not have access to a lot of money or to High Powered Attorneys. Typically the Realtors Do have access to a Whole lot of Money and an Endless Array of Big Shot attorneys.
NMAR spends a HUGE amount of money going to Washington DC, as do many other small REALTOR associations to fight for their rights, while the Real Estate Consumer has NO Rights at all. This is a Fact, Realtor Forms - supposed standard REALTOR forms are geared toward protecting the Realtor and they are NOT intended to Protect the Real Estate Consumer.
Realtors are NOT trained in what you think they know and Realtors Do NOT know what you, the real estate consumer NEEDS them to know.
The E and O insurance that the Realtors have Protects the Realtors from the Real Estate Consumer. This is SHOCKING but True, and to make matters worse, in some states it is mandatory that Realtors have E and O insurance. So another words it is Mandatory that those Realtors in those states protect themselve from the frivolous claims - needs and lawsuits of the Real Estate Consumer.
The Realtors FIGHT with all their might to Keep Banks out of Real Estate. The Realtors Bully the For Sale by Owner marketing Companies and even threaten the Local Real Estate Connection magazine with a boycott if they let the FSBO advertise in their magazine.
The Realtors Boycott those who Give the Real Estate Consumer a Discount, they make consumers think that if the Broker is giving you a discount then they are not offering a full service.. Flat Out Lie.
Buyers Rebates have been legal since April, is your Realtor giving you a Buyers Rebate.. no they are too greedy. But if another Broker Gives you Cash Back at Closing the Realtors make the Consumer think that this Broker is not to be trusted or is somehow not as good at their job. I have had MAR, Realtor attorneys tell me it was Illegal to Give a Buyers Rebate and even call it mortgage fraud, saw memos that use scare tactics to Keep Realtor from giving Breaks (Rebates) to the Real Estate Consumer.
Yet when I have Proof of Mortgage Fraud, Flat Out Fraud NO body is listening.. not the FBI who claims they are, not the Department of Justice.. Montana Banking and Commerce claims they are but by the time they move on anything documents are shredded and many more consumers are hurt. No one is looking out for the Real Estate Consumers best interest. It is a Simple Fact.
How Does the Public have a chance against the Realtors?
This Flathead Beacon article, which I have linked to at the bottom of this page, says that Montana is Young in Political activity with Realtors, is this a Flat Out Lie?
Or do they mean they are just more aggressive about it now because their livelihood is at stake? NMAR has been political active for many years. And pushing their political weight around is not NEW. Also MAR ( the Montana Association of Realtors) has also been quite active for quite some time in pushing their political agenda on local government. Yet they claim it is new for them and well watch out because here we come and there is No Stopping us, we are Realtors.
Where are the Realtors, NMAR when consumers are hurt and taken advantage of by the Non-Disclosure, Flat Out Lies and Misleadings of their members?
The Realtors are Self Governed and they Do NOT care about their members who lie to consumers to the point that they lose everything.
NMAR does nothing to make sure that the data in the MLS is correct. Whatever SOLD price the Realtor or their secretary enters, well that’s just the way it is. This data creates an entire real estate market and has no measure in place for quality control.
NMAR does not want to hear about members that hurt consumers. They are not out for justice for the real estate consumer, NMAR is out to Keep their jobs in a day and age where there is not one sensible reason to use a Realtor in your Real Estate Transaction.
NMAR Lobby’s to keep you the Real Estate Consumer out of their Database. Why? IT was your money, your life, your equity and your choice to work with the Realtor that Created the Database but they lobby in political arenas to keep you out of what they deem as "their database". They Get Politically active and they win, you do not get access to your own data.
Yet, it only takes one week to be a Realtor and then after you join the Club and pay the dues, well then you can see the data, Does this Make any Sense?
I know of past NMAR government affairs committee members who have lied to the real estate consumer, who did NOT disclose know problems with home, they Flat Out Lie and deliberatly deceive the Real Estate Consumer to get ahead financially and these are the kind of folks that are on these committees.
You Can bet that if the Association Of Realtors Wants it, then it (what ever it may be) is VERY bad for the Real Estate Consumer and Very Good for the Realtors.
There is NOT one Reason you Need a Realtor In your Real Estate Transaction. The Realtors will NOT go down without a fight, they claim that using a Realtor in your real estate transaction will “Protect You”, in NO WAY does using a Realtor offer you more Protection.
Just because all the Overpaid Realtors stand up for something does not mean it is what should be. The public may not even show up to fight, they know that they can not win against the Real Estate Cartel known as the Association of Realtors.
I am sure that the members of NMAR will NOT appreciate this POST. However, being an Ex-Member of NMAR I am VERY familiar with how the game is played. And I Do NOT appreciate the Tactics, lack of Ethics enforcement and Severe lack of consumer protection that goes on at NMAR – the Local Association of Realtors.
This article says that “In response to what they perceive as an increasingly regulatory environment for development” YOU have Got to Be Kidding. Kalispell, in particular has let so many developmenst go in that the infrastructure is buckling.
I have heard that Emergency Response and other area agencies cannot keep up with the growth. The County Governing body has been pushed – force and bullied by the Realtor and the Builders so much that Foreclosures have gone way up, homes sit empty, commercial space is practically begging for tenants and the insatiable appetite of the Big Builders – Develops and the Real Estate Cartel, (REALTORS) are calling for more development – more building, truly when does the Reign of the Realtor END.
Where does this bullying STOP? Why is the Rights of the Real Estate Consumer NOT Top Priority? Why do the Rights for the Realtors and the Developers to Make More Money mean more then the rights of the real estate consumers or what is really best for the Flathead Valley as a Whole?
The Realtors create quite a stir every time they don’t get their way. Who stands up for you when things don't go your way?
So the Cry Baby Association of Realtors is mad and throwing a tantrum because there may actually be some regulations to slow down the over development that is going on in the Flathead Valley.
And well the Realtors are going to stomp their feet and throw their weight around until the local government agencies give in (either because they can’t stand the stress of it or cannot afford to fight the Realtors.
This article says The Realtors are“ramping up their political activity to unprecedented levels”. Be Scared Consumers, be very scared, the Realtors will get their way. The National Association of Realtors is a Multi-Billion Dollar Company and they are not going to let anything stand in their way to getting what they want.
You better just give up now. The Realtor own the local planning and development process when they can Huff and Puff – Throw Money and Stomp their feet and End up Eventually get their way. NO Private Person – No Government agency can Out Last – Out Stand – Out Fight – Out Spend the Association of Realtors … YOU Lose.
The Department of Justice gave up their fight with the Realtors, they “Settled” because they could not keep fighting and they could not get the Realtors to Admit to Anti-Trust Violations though the Realtors Really do Violate Anti-Trust Laws.
A Realtor Paid “government affairs director” – George Culpepper - jotting down notes to take back to NMAR, how intriguing. A Realtor snitch running back to the Board of Realtors, who is Self Governed, and telling on the County for making decisions that are in the best interest of the County. Once the “Snitch” tells NMAR – they get everybody together and they attack the rights of the Residence of Flathead County, and most of the Time they Win.
If NMAR has hired a Full Time “government affairs director” – watch out, the Realtors know that they are not needed. The Realtors know that with the Internet it is easier – cheaper and offers more protection for Buyers and Sellers to work together directly.
So they are rallying, the are ramping up their fight. The actually fight is for Realtors to keep their jobs when really you Do Not Need a Realtor in your Real Estate Transaction and in Fact, using a Realtor in your Real Estate Transaction will cause more harm then good.
This article says that this NMAR paid for “government affairs director” “expanded his political influence when he was appointed to the Flathead County planning board.” There is No end in sight to the Affiliations, Corruptions, Bullying, and Forceful tactics of the Association of Realtors.
Why is this NMAR Paid Snitch now on the planning board, my guess, Flathead County could not take the pressure the Realtors were putting on them so they let this NMAR PAID for “government affairs director” on Your Flathead Valley Planning Board.
Inside Information, Conflict of Interest, Lack of Consumer Protection – Now the Realtors are in Charge of the Fate of Flathead Valley and what this means is that Realtors will get to keep their jobs for awhile longer in the Flathead Valley of Northwest Montana.
The Realtors join with the Builders and Sue the County, and now this guy is on the County Board, it reeks of a take over to me. Developers and Realtors banding together in numbers and money and taking over Your Government which is no longer of the People, by the People, for the People.

Dissatisfaction over investigations into alleged rapes has prompted a number of North Lincoln County residents to consider a recall of the sheriff. Organizers promise a petition to that effect.
If one is actually circulated, other residents would do well not to sign it for two reasons. First, there is no sufficient legal grounds to recall the sheriff.
Second, and more importantly, a recall solves nothing.
Montana is one of 17 states that allow citizens an avenue for removing elected officials from office. But that power is limited. State law allows recall of an elected official for lack of physical or mental fitness, incompetence, violation of oath of office, official misconduct, or conviction of a felony offense.
None of these in fact apply to Sheriff Daryl Anderson.
The law that subjects Anderson and every other elected official to recall specifically states: "A person may not be recalled for performing a mandatory duty of the office that the person holds or for not performing any act that, if performed, would subject the person to prosecution for official misconduct."
It's one thing to disagree with the sheriff on decisions he makes. We certainly have had occasion to do so. But it's quite another to allege misconduct and incompetence when neither apply.
A recall is therefore inappropriate.
And recalling the sheriff solves nothing. Implementing a public affairs protocol would.
We've pointed out in the past that the sheriff's department in Libby sorely needs a trained liaison to deal with the public, which has every right to raise questions and expect answers.
The tempest brewing over these investigations is another case in point of failed communication.
It can be done right. Officers right here in North Lincoln County are evidence of professional, courteous communication.
Equal treatment from Libby solves a problem.
Backing a doomed recall of the sheriff does not.
Lincoln County knows full well from a former justice of the peace in Libby that elected officials must on occasion be removed from office. " Unquote...

I say, I have talked with endless people over decades and I certainly know, without a doubt, how nasty - vile - and disturbing the crime has been in Lincoln County with seemingly no end in site. r I have spoke with you folks out there over and over, I know that you don't believe all the TVN tells you to believe, I know that you are frustrated with Steve Newman's version of the News and that you weep for victims of all crimes. You write letters, you beg for help and no one has ever listened. You have Been Ignored, and in that things did not magically get better, but instead they got worse.
You may not like me, you may not approve of me, but EUREKA you know me. And this is not about our differences, this is about what we have in Common. r I am connected to old and new rexford, I am a product of this valley, I love Eureka Montana. And what has been happening here is very wrong and has been happening a very long time. r We now have a newcomber to our area with the Backbone to Stand up for us all and the patience and knowledge to wade throught the Montana Judicial Process to do it right. r If we do not back up this Tobacco Valley "stranger", this white knight passing through our lives, then we will have no say in the future as these crimes continue to be unpunished and SHOCKINGLY unbelieved.

Carole King Joins Rep. Carolyn Maloney in Supporting the Northern Rockies Ecosystem Protection Act
Washington, D.C. -- Today, pop music legend Carole King joined Representatives Carolyn Maloney (D-NY) and Raúl Grijalva (D-AZ) in announcing the introduction of the Northern Rockies Ecosystem Protection Act (NREPA). NREPA would protect some of America's most beautiful and ecologically important lands while saving taxpayers’ money and creating jobs. “Many of America’s most precious natural resources and wildlife are found in the Northern Rockies,” said Rep. Maloney.
“NREPA would help protect those resources by drawing wilderness boundaries according to science, not politics. NREPA would also help reduce global warming by protecting the corridors through which vulnerable wildlife can migrate to cooler areas.”

In the Mean Time How Much Damage has Tom Burk been able to Legally "Get Away" with?
Well all the numbers are not in yet, however, we do know of several cases Tom Burk acting in a way that did not benefit the real estate consumer. I, myself, was involved in one of those cases where we provide Top of the Search Engine marketing for a Seller, directed the traffic online to the Seller with Coldwell Banker's "permission" to help keep the Seller from foreclosure, and this marketing was FREE.
In 2 days we had calls coming in and we had that Seller EVERYWHERE, Coldwell Banker let us do all this work and then they brought the Hammer down and told us to stop. Even though the Seller Directly Benefitted and Coldwell Banker would still have gotten the Commission. Coldwell Banker Kalispell is as Anti-Consumer as it gets.
Tom Burk of Coldwell Banker Kalispell seems to believe that it is ok to market real estate with Lake Access, to have this in the Buy Sell agreement, to have the Lake Access in the Advertising and on the MLS but to not really "Prove" that their really is lake access.
And when the Unsuspecting Buyer goes to Use the Lake Access or to Sell with Lake Access and they find out that they really do not have Lake Access and that their property does not have ANYWHERE near the value they thought it had, Tom Burk says it was a Clerical Error, he admits that he knew the access was Revoked 10 Years Ago and he says "The Matter is Closed". So there you have it, Lake Access Real Estate Is worth a HUGE amount more money and then real estate without Lake Access, everyone EVERYWHERE knows that. But Tom Burk is playing dumb, and saying oh, sorry, my bad.. but your problem..
Coldwell Banker Kalispell Admits to this FRAUD, and Blatant Non-Disclosure but the unsuspecting Real Estate Consumer is left to fight for what they thought they were buying in the first place. Housing and the Obama Stimulus Package: 1. The $790 billion stimulus package hammered out by House and Senate conferees late yesterday increases the home buyer tax credit to $8,000, from $7,500, and drops the repayment feature for buyers who hold on to their property for at least three years.
2. Increased funding for the Rural Housing Service direct and guaranteed loan programs.
3. Over $50 billion in it for foreclosure mitigation, with Geitners Treasury plan signaling that the second half of TARP and TALF will be used to mitigate foreclosures through a government guarantee.
4. Fannie raises the cap of investment properties eligible for loans from 4 to 10.
5. Preservation of mortgage interest deductibility, real estate tax deductibility, and the $250,000/$500,000 cap gains exclusion.
This week's rates: Average interest on 30-year fixed loans fell to 5.16 percent from 5.25 percent last week. Interest on 15-year fixed loans also declined, slipping to 4.81 percent from 4.92 percent.
Home sales show gain: The Pending Home Sales Index rose 6.3 percent to 87.7 from an upwardly revised reading of 82.5 in November, and is 2.1 percent higher than December 2007 when it was 85.9.

Did you Guys Here this, apparently December was Kalispell Montana's month for this years new Police force that is being called the "Goon Squad". It is said that there are a group of 10 Highway Patrolman that travel from City to City in Montana, spending a month at a time. So they can crack down on traffic tickets. I sure wish there was a Goon Squad cleaning up the streets from Meth Addicts, Dealers, Rapists, and other Crimes that are seeminly going unpunished.. but speeding well watch out .. the Goon Squad will get you.
I heard of 5 cars pulled over in 20 minutes, in the home depot area of Kalispell Montana and given tickets for speeding in a Construction zone when they were well past the Construction Zone.

Spirited public debate is a cornerstone of the American political system. We have seen plenty of it at Whitefish City Council meetings, and although at times it may be uncomfortable, I would argue that it is a positive thing, resulting in better public policy.
Comments made by the Northwest Montana Association of Realtors in a May 23 article in the Daily Inter Lake, however, crossed the line.
In the article, NMAR's paid spokesperson, George Culpepper, Jr., implied that the city was acting in an underhanded fashion, and furthermore, that the city might engage in a coverup.Let me say this once, loud and clear, for everyone to hear -- the city does not operate that way.During my two-year tenure on the city council, I'm happy to say that I've seen no evidence of unethical conduct on the part of the council or city staff.
To the contrary, I have observed a culture of carefully following the law, the intent of the law, and beyond that, of just doing what is "right." Whether they agree with individual policies or not, the citizens of this community can feel proud of their city and the way it conducts business.
I called Mr. Culpepper to express my dismay at his statements. He does not have any evidence of the city behaving improperly or hiding anything.A free and open debate on the issues is healthy. But unfounded accusations of conspiracy and coverups only serve to divide us unnecessarily, and are a disservice to the community.
I invite NMAR to instead work with the city cooperatively.
"The city," after all, is really just your neighbors. There are areas where we could work together for the benefit of all.For example, there's no denying that the city's Critical Areas Ordinance has presented the real estate agents that the NMAR represents with a new challenge in terms of understanding the effects of the ordinance and knowing how to advise their clients. Real estate agents need accurate information about the requirements of the ordinance for various types of properties.
I offer to work with NMAR and city planning staff to develop an informative document tailored to the needs of the real estate community. Planning staff could also host a question-and-answer session regarding the Critical Areas Ordinance for real estate agents and other interested members of the community. I will be contacting the NMAR board shortly to follow up on these ideas. Let's work together. Nancy Woodruff is a Whitefish city councilor.
There is no shortage of litigation conversation in Whitefish these days, with plenty of indication that the city’s decision to sue Flathead County is only the first of what could be a series of lawsuits involving the “planning doughnut” and the critical areas ordinance.
City Attorney John Phelps has publicly acknowledged he expects the city to be sued. But until that happens, both the city and county will have their hands full with Whitefish’s current litigation. On March 13, Flathead County commissioners voted 2-1 to rescind a 2005 interlocal agreement that gave Whitefish final land-use power in a jurisdiction outside of city limits – the doughnut area. Then on March 17 the Whitefish City Council voted to sue the county and Phelps subsequently asked the Flathead County District Court for a temporary restraining order to prevent commissioners from acting outside of the interlocal agreement until the city gets a hearing.
Phelps had previously warned in a letter to commissioners: “Do not underestimate our resolve.” “An effective working relationship between the city and the county depends on forthrightness, honor, and fair dealing between their elected officials,” Phelps wrote to commissioners. “If the Flathead County commissioners cannot be relied upon to honor an agreement of this stature, what credibility do they retain?”Other parties are already getting involved too.
Sean Frampton, who has been the attorney in the only two major lawsuits Whitefish has lost since Phelps came to office, said he plans to file a motion to intervene in Whitefish’s lawsuit against the county. Frampton is arguing that the interlocal agreement was invalid from its inception for a variety of reasons.
One of his main arguments is that, based on his readings of interlocal statutes, an interlocal agreement can provide Whitefish with planning privileges in an extraterritorial jurisdiction, but not zoning power.“There are many, many reasons why I see this agreement isn’t valid,” Frampton said.
At recent city council meetings, members of the public have expressed concern that the city is being cavalier in its approach to the perceived inevitability of litigation.
At one meeting Councilor Nick Palmer said he wasn’t too worried about lawsuits after passing the critical areas ordinance because the city has the “legal equivalent of Joe DiMaggio” in Phelps.
George Culpepper Jr., government affairs director for the Northwest Montana Association of Realtors (NMAR), warned that the city should be more cautious. Culpepper said NMAR is discussing litigation against Whitefish, though nothing has been hammered out.
NMAR Threats and Warnings ? Why Does a Local Assoction of Realtors, really just a group of Real Estate Agents. Why to they have so much Political Pull... Why do they have the Right to Issue "Warnings" to your local government who was elected to and is paid to make decisions that are in your Best Interest. NMAR over steps their boundaries on and an ongoing basis and there is No End in Sight.

I have heard that in the NMAR is in some sort of Lawsuit against the Whitefish Council. Apparently NMAR wants to investigate the actions, payroll and other pertinent details to and surrounding council members. I am not sure if this is on the behalf of Consumer Protection or if it is a way for the Realtors to Huff and Puff and throw a big fit to get the Whitefish Council to Do as they Say.
I am sure that NMAR should be focusing its efforts on policing it's own industry. NMAR does not do Audits of it's members to make sure that the data they enter into the MLS is correct, NMAR is not concerned or even cares to hear about members who have failed to disclose which led to severe losses of real estate consumers. There is so many Ethics and Consumer Protection issues that NMAR could be fighting for. But instead they use their Power - Numbers - Money and Attorney access to Push for More Development. While at the Same time the Real Estate consumer is buckling under the weight of the stress and financial damage NMAR members have done to them. Yet NMAR will not hear of this, they do nothing that really benefits the Real Estate Consumer, all in the Name of Consumer Protection and what is "Really" best for the Community.
Bullying ? Cartel ? Real Estate Mafai ? and they call it a "Higher Standard of Practice".
